Welcome to URBANBITE. These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “Customer”) and URBANBITE (“we,” “us,” “our,” or the “Platform”) governing your access and use of our website, mobile application, and related services (“Services”).

By accessing our platform, creating an account, or placing an order, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.

2. Eligibility

You must be at least 18 years of age to use our Services. By using URBANBITE, you represent and warrant that you are of legal age to form a binding contract under Indian law

3. Nature of Service and Platform Role

URBANBITE operates as an online intermediary and food aggregator platform. We provide a digital marketplace that connects Users with independent restaurant partners (“Restaurant Partners”) and independent delivery service providers (“Delivery Partners”).

  • We are not a Restaurant or Delivery Service: URBANBITE is not a manufacturer, seller, or distributor of food, nor do we provide delivery/logistics services

. We facilitate the placement of your order with the Restaurant Partner and connect you with a Delivery Partner.

Contractual Relationships: The actual contract for the sale and purchase of food is between you and the Restaurant Partner. Similarly, the contract for delivery services is between you and the Delivery Partner. URBANBITE is not a party to these contracts and disclaims liability for the actions, omissions, food quality, or service deficiencies of Restaurant Partners or Delivery Partners

Compliance: We require all our Restaurant Partners to comply with applicable laws, including possessing a valid FSSAI license, which should be displayed on their store page. URBANBITE will delist partners found to be non-compliant

4. User Account and Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to:

  • Provide accurate, current, and complete information during registration and order placement.
  • Update your information to keep it accurate.
  • Be available at the delivery address and time, and ensure the address and contact details provided are correct

  • Use the Services only for lawful purposes and not engage in any fraudulent or harmful activity.

5. Orders, Pricing, and Payment

  • Order Placement: Clicking “Place Order” constitutes your irrevocable authorization for URBANBITE to place the order with the Restaurant Partner on your behalf

. All orders are subject to acceptance by the Restaurant Partner, which is at their sole discretion.

Pricing: Menu prices are set by Restaurant Partners. While we strive for accuracy, final prices may vary, and the price charged by the Restaurant Partner is deemed correct

  • . All prices are in Indian Rupees (INR) and inclusive of applicable taxes unless stated otherwise.
  • Payment: You agree to pay the total order value, including all applicable delivery charges, taxes, and fees. Payments are processed securely by third-party payment gateways. URBANBITE does not store your card or UPI PIN details.

6. Delivery

Delivery times are estimates and may vary due to traffic, weather, restaurant preparation time, or other unforeseen circumstances. URBANBITE and its Delivery Partners are not liable for such delays. You are responsible for providing a correct and accessible delivery location.

7. Cancellation, Returns, and Refunds

  • By Customer: Once a Restaurant Partner has accepted and begun preparing your order, you cannot cancel it. An attempt to cancel after acceptance constitutes a breach of your authorization, and you may be liable for the order value

  • By URBANBITE/Restaurant: We or the Restaurant Partner reserve the right to cancel any order due to unavailability, unserviceable location, technical errors, or other operational reasons. In such cases, a full refund will be issued.
  • No Returns: Due to hygiene and food safety reasons, all food items are non-returnable and non-exchangeable once delivered.
  • Refunds: Refunds are processed as per our separate [Refund & Cancellation Policy], only in eligible scenarios such as order cancellation by us, non-delivery, or payment failure.

8. User Conduct and Prohibited Activities

You agree not to:

  • Use the Services for any illegal purpose.
  • Harass, abuse, or harm our employees, delivery partners, or restaurant staff.
  • Impersonate any person or entity.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Use any data mining or extraction methods.

9. Intellectual Property

All content on the URBANBITE platform, including text, graphics, logos, images, software, and the overall “look and feel,” is our property or licensed to us and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes

10. Limitation of Liability

To the fullest extent permitted by law, URBANBITE, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

Our total liability for any claim related to the Services shall be limited to the value of the specific order that gave rise to the claim or INR 500, whichever is lower.

This limitation applies to, but is not limited to, liability for:

  • Food quality, safety, or taste preferences.
  • Delays in delivery or order fulfillment.
  • Actions or omissions of Restaurant Partners or Delivery Partners

  • Any illness or allergic reaction related to food consumption.
  • Errors in pricing or menu information.

11. Dispute Resolution and Arbitration

  • Mandatory Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996. Arbitration shall be conducted by a sole arbitrator mutually appointed by the parties.
  • Class Action Waiver: You waive any right to participate in a class action lawsuit or class-wide arbitration.
  • Governing Law and Jurisdiction: These Terms are governed by the laws of India. Subject to the arbitration clause, the courts in the jurisdiction where URBANBITE’s registered office is located shall have exclusive jurisdiction
